Labor law as a branch of law. The law was born of life and its conflicts. Life, beyond what charm means, means daily struggle and permanent work. In his life, lived as a social reality, man learned to think religiously, morally, economically and to the same extent, he had to think legally. Labor law as a legal science. The unitary system of Romanian law comprises a set of norms regulating a distinct category of social relations, having its own method and community of principles.
The main normative act of labor law is the Labor Code.
The main area of regulation of the legal norms stipulated in the Labor Code considers the individual and collective labor relations, which are established between a natural or legal person, an employer, and a natural person, an employee, as well as between employers, unions or employees’ representatives and public authorities. Regulated by different normative acts, assumed by the individual contract and, as the case may be, collective labor, the social labor relations become legal labor relations, whose essential specificity is the subordination, according to the law, of an individual / group of individuals to the a socio-economic unit, with a defined organizational structure and an accepted functional hierarchy.
The labor code is the normative act that brings together the norms that constitute the common law in the matter of labor relations.
